People v. Confidential

Case Number: 2007-26-776
Unlawful Use of a Weapon
Case Dismissed
26th & California, Chicago

Chicago Police claimed that they received a call of a person with a gun at the residence of Mr. A. Officers also claimed to have obtained consent to search the apartment from Mr. A’s roommate. The officers recovered a sawed off shotgun from Mr. A’s bedroom. I filed a motion to suppress based on the fact that the roommate could not give the police permission to search another person’s room. The judge agreed and the case was dismissed.

The Chicago Police claimed to have received a call that our client was not supposed to be in the area and that he had a gun in his vehicle. During the search they found a .45 caliber hand gun. At a motion to suppress, I proved that the officer illegally search our client and violated his 4th Amendment rights.
