Chicago Police Officers Johnson, Chinchilla, and their team got a search warrant for 9147 S. Wentworth. When the officers arrived at the location they found out that the building contained 2 apartments which made their warrant unconstitutional because it did not state which apartment to search. The officers searched both and found guns and charged my client with Armed Habitual Criminal and UUW.  At a motion to suppress I proved to the judge that the search was bad and was not allowed by any good faith exception. The judge finally agreed and granted my motion.

Motion Granted, Case Dismissed

Chicago Police Officers Flores and Crot pulled our client over for traffic offenses in the area of 7700 s Paulina.  They said he had been moving around in the car so they took him out of the vehicle and conducted a search. In the car they found a gun and charged him with a UUW. At a motion to suppress I showed the judge the body camera and proved that the police had no right to pull my client out of the car and start searching. The judge agreed and suppress the gun.

Chicago Police Officers Flores and Mieszcak pulled my client and his passenger over in the area of 300 S. Kostner and started to search his car. They found a 9mm Smith & Wesson hand gun in the center counsel. The officers tried to put the gun on my client because he was a convicted felon. At trial, I proved to the judge that the gun belonged to the passenger who lawfully purchased the gun in Indiana and that my client had no knowledge of the gun.

Cicero Drug Case – Not Guilty

Cicero Police Officers Sandoval and Cervantes were on routine patrol in the 6000 block of Cermak Road when they saw my client driving without headlights on. The officers pulled my client over and found that he did not have license and insurance. During a search of the car they found bags full of cocaine. At trial I proved that the car was titled to a someone other than my client and that my client was just borrowing the car that night. The judge agreed that my client did not know about the drugs in the car.

Meth Case Thrown Out

Chicago Police Officers Soto and Stec claim to be on routine patrol in the area of 1223 S. Millard Avenue when they saw my client walk over to a car. The officers said that they thought there was going to be a hand to hand drug transaction so they watched our client. The officers then claimed that a plastic bag was sticking out of our client’s pants pocket.  They stopped out client, pulled the bag out of his pocket and found that is was full of meth.  At a motion to suppress evidence, we proved that the police did not have probable cause to stop our client and pull any bags out of his pocket.  We cited People v. Garcia and the judge agreed with me.
