Ms. G and her two cousins were charged with robbing a pizza deliveryman. Prior to the robbery she was standing outside with her cousins and joked about robbing a pizza deliveryman who was across the street. Two of her cousins decided to go across the street and commit the robbery. Afterward she ran. At trial I presented case law that showed that just making a joke about a robbery is not enough to be held accountable for the crime. The court agreed after a hearing on a motion to reconsider. Finding of Not Guilty.

A forest preserve officer was putting a parking ticket on Mr. F’s girLfriend’s car when he started to question Mr. F. The officer claimed that Mr. F did not give his real name. For trial we subpoenaed Mr. F’s now ex-girlfriend who would have testified that Mr. F cooperated with the officers and that it was the officers who were violent and disrespectful. Case was dismissed just prior to trial.

Mr. B was a passenger in a car that was pulled over for a traffic offense in the area of 4810 W. Flournoy Street. The officer claimed that Mr. B was making furtive movement so he had him get out the car and then patted him down. While patting down his pants between his legs near his buttocks he found 16 bags of heroin. At a motion to suppress, Attorney Levinsohn proved that the officer was not in fear of his safety and had no reason to search Mr. B in and around his buttocks. No probable cause to search. Case dismissed.

Possession of a Controlled Substance with intent to Deliver

Chicago Police Officers executed a search warrant and found Mr. A in the same apartment with 16 bags of cocaine, two digital scales, and an unopened child support letter from the year before. At trial, we showed that Mr. A was over at his mother’s home visiting. His aunt, brother, and sister testified that he move out and was living with his girlfriend. Attorney Levinsohn showed that Mr. A did not have keys to the apartment, that none of his clothing was found in the apartment, and the year old mail to Mr. A was unopened. Finding of NOT GUILTY.

Possession of a Stolen Motor Vehicle

Mr. M was accused of steeling a car from a used car lot. The police found the stolen car parked in front of Mr. M’s apartment building with plates registered to Mr. M. During the defense we proved that Mr. M’s plates were stolen off his vehicle. Attorney Levinsohn used the security video from the car lot and cross examination of the car lot owner to show that someone else had stolen the car and put Mr. M’s plates on the car without his knowledge.  Finding of NOT GUILTY.
