Chicago Police obtained a search warrant for Mr. D and apartment near Keeler and Maypole. The officers searched and found 3 guns (two Smith & Wessons and a Ruger) but they did not find Mr. D. He was arrested two days later in a car at 500 N. Hamlin. At trial, the police claimed that a few pieces of old mail showed that Mr. D lived in the apartment and that the guns were his. Attorney Levinsohn showed that he had moved out of that apartment months ago that he didn’t even have a key to the apartment. In addition there was mail for other people found at the apartment. Finding of NOT GUILTY.

Cannabis Charges Dismissed – Bad Stop 1022

Chicago Police Officers were in the area of 95th and Princeton and claimed that they saw a person come up to Mr. G., who was a passenger in a car. Officer Jose Lopez testified that he saw an unknown person give an unknown amount money to Mr. G for an unknown object. Mr. G then drove away. Officer Lopez and Morsi then pulled Mr. G over, searched him and found cannabis. At a motion to suppress, Attorney Levinsohn proved that the officers had no probable cause to stop Mr. G or search him. Case Dismissed.

Chicago Police Officers came up to Mr. R who was a passenger in a SUV stopped behind his home in the alley near 73rd and Damen. The officers claimed that the SUV was illegally parked and they pulled the driver, passenger and Mr. R out of the vehicle, searched them, and then searched the vehicle. They found a gun inside of the SUV and put it on Mr. R. At a motion to suppress, Attorney Levinsohn proved to the judge that the officers did not have probable cause to search the car or its occupants. The motion was Granted and the case was dismissed

Chicago Police Officers claimed that our client purchased heroin from a codefendant in the alley near 45th and Lawler and arrested both of them. Attorney Levinsohn spoke to the residents and learned that the codefendant and his family lived at that location and that our client was a friend of the family. The Residents also stated that the police broke into the house and arrested the codefendant and our client in the basement and neither had drugs with them. Attorney Levinsohn presented this evidence to the prosecutor prior to trial and the case was Dismissed. The codefendant had a different attorney and pleaded guilty prior to our client’s case being dismissed.
