Chicago Police Officers Allenson and Turbak were on gang enforcement patrol in the area of 4800 W. Jackson. They claimed that my client was a passenger in a car and was not wearing his seatbelt so they pulled the car over. They had my client get out of the car and then saw a plastic bag sticking out of his shoe. Officer Turbak then grabbed the bag and found that it had heroin in it. At a motion to suppress, I proved to the judge that Officer Turbak was not allowed to just grab things from my client. The state could not use the heroin at trial so the case was dismissed.
Dismissed.
