Chicago Police Officers Warjas and Yapdiangco were on patrol when then ran the plates on a Jeep Cherokee at 4741 W. Polk. The car came back stolen so they came up to the car and put our client into custody even though he had the keys to the car. At trial, the state claimed that our client was one of two people that carjacked Miguel Mendoza while he stopped to urinate in the alley but we proved that our client was not identified in a lineup. We also proved that our client borrowed the car with the keys from a friend and had no idea that it was stolen

Chicago Police Officers Montalvo and Urbanski responded to a man with a gun in the area of Homan and Jackson. The officers started to drive around the area when they saw our client standing by a car parked at 320 S. Spaulding.  Our client got into the car and was ready to leave the area when the police claimed that he matched the description of a person committing an aggravated unlawful use of a weapon.  Our client tried to run but the police grabbed him and found a gun.  At a motion to suppress evidence, we proved that the police did not have probable cause to stop and search our client.

Chicago Police Officers obtained a warrant to search an apartment at 1143 S. St. Louis.  They thought our client lived there.  Officers Anthony Babicz, Justin Homer, Osbiel Montoya, and others forced their way into the apartment and found a 45 caliber gun, ammunition, and heroin.  They tried to put it on our client but at trial we proved that our client did not live at that address and that the drugs and gun belong to the people who were present in the apartment when the warrant was executed.

Criminal Sexual Assault at a Party

Our Client and his girlfriend were charged with Criminal Sexual Assault by Orland Park Police when at the end of the night they had sex with one of the people at the house party. The complaining witness claimed that she was too drunk to consent and that she was raped. At trial attorney Mike Levinsohn proved that the complaining witness gave our client her phone number and french kissed our client’s girlfriend. Orland Park Detectives Hartsock and Ahrendt tried to get our client’s girlfriend to incriminate him but it didn’t work. We proved at trial that the sex was consensual and the witness was embarrassed because she was engaged to another man. Finding of NOT GUILTY
